Ben Linden is an IP attorney who advises clients on the strategic development, licensing, and enforcement of IP assets. He helps clients navigate complex legal and business issues involving technology commercialization, licensing relationships, and IP disputes. He represents a diverse range of clients across technologies including wireless communications, natural language processing, speech codecs, graphical user interfaces, online analytics, and search engine optimization.
Ben has significant experience counseling clients on IP licensing, including negotiation and enforcement of licensing agreements, software and technology contracts, trade secret matters, and standard essential patent (SEP) licensing. He has advised clients on every stage of SEP portfolio management, acquisitions, licensing, and litigation involving standards organizations, providing practical insight into preserving and maximizing the value of IP portfolios over time.
His litigation experience includes serving as trial counsel in patent, trade secret, software licensing, and contract disputes, including recently as a member of the trial team that secured a $66.9 million jury verdict in a patent infringement case, and obtaining a complete defense verdict in a complex software licensing and copyright dispute. He combines transactional and courtroom experience to inform his practical approach to structuring licensing relationships that anticipate future challenges and reduce litigation risk.
Before entering private practice, Ben worked for BAE Systems supporting federal biometric identification programs and information technology management, applying his background in computer science. A frequent speaker and author on IP issues and strategy, Ben regularly presents on drafting effective licensing agreements, avoiding licensing disputes, and protecting value throughout the commercialization lifecycle.
